Only a few short years ago, it used to be fairly easy to file bankruptcy, almost as easy as it is in the board game of Monopoly, where the ramifications of doing so were about the same as in Monopoly. But it was determined that so many people were taking advantage of bankruptcy to compensate for a lack of financial skills, a lack of money management, and basically attempting to lead a champagne lifestyle on a beer budget that the bankruptcy laws were recently changed.

To be sure, the bankruptcy laws still vary from state to state, but there are some things that even state legislature cannot disagree on if they conflict with the federal bankruptcy laws. Even at this, some people have attempted to file bankruptcy in a state that may have more lenient bankruptcy laws than the state in which they have listed as their address of residence, and one of the things that the new bankruptcy laws is doing is ensuring that people who file bankruptcy do so in the state in which they live.

Another requirement of bankruptcy with the new laws is that the person filing bankruptcy is required to attend credit counseling sessions and financial education courses. While this is still part of the law and you can expect that requirement into the foreseeable future, studies are starting to show that such a requirement has so far failed to deliver the positive results that were expected, and in fact have delivered very few significantly measurable benefits to the consumer.
Is there a value to requiring consumers to spend (or as some say, “waste”) their time on credit counseling and financial education courses before being allowed to file bankruptcy? Many are saying it makes no sense at all. On one hand, the advocates who say it makes little sense are right, since by the time a person is so far in financial distress that bankruptcy is their most viable option, the time for financial education and credit counseling has long since passed. But on the other hand, how do you require someone to attend those classes and counseling sessions BEFORE they get into a bankruptcy situation, since the vast majority of people are unwilling to admit, even to themselves, that they are heading in the wrong financial direction.

Good consumer information about bankruptcy is one answer. While the government or the state cannot protect each and every consumer from financial folly, nor can they force the consumer to attend courses or counseling, they can put the monkey on the consumer’s back by making information about bankruptcy available, perhaps even at no charge. The vast majority of consumers have no clue about the various chapters of bankruptcy and which one they should choose if they get into a bankruptcy situation.

Moreover, most consumers think of bankruptcy as their only option, when in reality the act of declaring bankruptcy should be the option of last resort. There are many viable alternatives to bankruptcy, most of which do not have the long-lasting negative impact on the consumer, such as the fact that bankruptcy stays on one’s credit report for the next 7 to 10 years. Consumers should be taught about the options that are available before considering the “act of last resort”, which is bankruptcy. For example, debt consolidation firms can pull a consumer out of the financial fire without requiring bankruptcy in many situations.

Consumer education about bankruptcy is paramount, and every consumer should make a point to understand at least the basics of bankruptcy, what it means, how it works, and most of all, what viable alternatives to bankruptcy are available.

For the benefit of those who have got no idea what this term mean, I will start by defining what exactly it is. Bankruptcy is a lawfully declared incapacity of an individual or organizations to pay their creditors or lenders at a given period of time. Creditors may file a bankruptcy plead against a debtor which is called -involuntary bankruptcy, in an effort to recover a section of what is due to them. Commonly, many bankruptcy cases, however, are initiated by the debtor called a voluntary bankruptcy that is filed by the insolvent entity or business.

Even though bankruptcy permit a debtor a way out of a violent cycle of debt, it should not be taken carelessly, and should be a means of last option. But in this particular article, I will concentrate more on the two main types of bankruptcy which is the chapter 7 and chapter 13 bankruptcies. They are widely used for personal bankruptcy individual, a debtor surrenders his or her non-exempt property to a bankruptcy trustee who then liquidates the property and distributes the proceeds to the debtor’s unsecured creditors.

Chapter 7 type of bankruptcy as straight bankruptcy is the favorite option for people with less or no property and a batch of unsecured debt. It is a liquidation bankruptcy implicating that the court will trade any non-exempt assets you have to pay your creditors and irrespective of the quantity paid, release that debt. The debtor will not be granted a discharge if he or she is guilty of certain types of unsuitable behavior such as concealing records concerning his financial condition.

Similarly some debts such as spousal hold up, student loans, some taxes will not be discharged even though the debtor is usually discharged from his or her debt. Many individuals in financial distress own only exempt property like household goods, an older car and will not have to give up any property to the trustee. The amount of property that a debtor may let off varies from state to the other. Chapter 7 type of a bankruptcy, relief is available only once in any eight year period. Generally, the rights of secured creditors to their collateral continues even though their debt is.

Chapter 13 type of Bankruptcy, from time to time called the wage earner’s plan, or reorganization bankruptcy, is quite different from Chapter 7 bankruptcy which swab out most of your debts. In a Chapter 13 bankruptcy, you employ your income to pay some or all of what you are obligated to your creditors over time which is proximately anywhere from three to five years, depending on the size of your debts and income.

These debts must also be non-contingent and liquidated, meaning that they must be for a certain, fixed amount and not subjected to any conditions. Secured creditors may be entitled to greater payment than unsecured creditors. Most people today are going to court to seek protection from the harassment of creditors once they have been unable to pay their debts. There are mainly two chapters under which bankrupt people can file a petition. The liquidation chapter has some of the debtors property sold in order to pay off outstanding debts. There are several facts that the debtor must equip himself with when such a situation occurs.

In Personal bankruptcy filing, one can protect their personal property from being taken over by the creditors. One risks being sued by the creditors and loosing all they have if they do not file a financial distress petition in court. This move will protect the consumer property especially if the property cannot cover the debt once sold. The court must evaluate property such as an automobile and house, if they will not be worth the net debt then the debtor will be allowed to retain such property.

Many people live in fear that once they file a personal insolvency petition, creditors may continue to harass them. The truth is that immediately the court has received the petition, it stops the creditors from any collective action against the debtor. The court appoints an attorney who is to answer to any creditors. There will be no more communication between the creditor and the debtor once the petition has been filed.

Debtors should be advised that personal bankruptcy could be the only option left when all has been done to no avail. It is important for anyone willing to go this way to get advice from the appropriate persons to allow them make informed decisions.
